Yesterday I wrote a quick piece on Virtual Steroids being down. The downtime actually lasted longer than expected, and customers began to wonder whether the bot will ever come up at all. New customers found themselves 30 Euros short, and without a bot. The Virtual Steroids Facebook page was not updated either; apparently it was created by fans. The VS Twitter account was taken down just before the outage occurred, an unfortunate coincidence that just compounded the problem.
A thread was put up in a major botting forum, the OP claiming to have disputed the funds for the Immortal key he had purchased. This was a very hasty decision, considering the site had only been down for about 20 hours at the time. Outages of this kind are very common; even moreso for newer sites that are still dealing with growing pains. I should know, because I have dealt with it personally.
Virtual Steroids (virtualsteroids.com), creator of the Immortal bot, are currently experiencing some issues with their server and should be back online "within a few hours".
The downtime was supposedly caused by a DDoS attack. Straight from the horse's mouth:

The creators of the famous WoW bot, Honorbuddy, are working hard on their own Diablo 3 bot, aptly named Demonbuddy. Honorbuddy was one of the better bots ever designed for WoW. This is evident by the ongoing lawsuit brought on by Blizzard. Should Demonbuddy prove to be as good as Honorbuddy, we could have a new contender for 'best Diablo 3 bot'. I still consider Diablo 3 Immortal to be the best bot, currently.
That is the million dollar question, isn't it? This question is asked again and again in every major botting forum.
The answer? Yes and no. No bans have yet been confirmed, but that doesn't mean Blizzard isn't watching. I have personally botted for days on end without a break. Hawker, administrator over at The Buddy Forum, says "we have found Warden", and if the Demonbuddy team isn't reliable, I don't know who is. Seems like a pretty conclusive answer to me.
That being said, you aren't necessarily under immediate threat of getting banned. Warden may be active, but that doesn't tell us anything about its capabilities. It may be presently active as a placeholder program, only to be improved with later patches.
If Warden has the capabilities to catch and ban people right now, you're probably already on "the list", so keep on botting.
Otherwise, you're still safe, and keep on truckin'.
